Terms and Conditions

Effective Date: April 24, 2026

1. Acceptance of Terms

By booking services with One27 Media LLC (“One27 Media,” “we,” “us,” or “our”), checking the acceptance box at the time of order, or otherwise engaging our services, you (“Client,” “you,” or “your”) agree to the Terms and Conditions in effect at the time of that booking. One27 Media reserves the right to update these Terms at any time without advance notice. The Terms posted at the time you place an order govern that specific order.

2. Client Eligibility

One27 Media primarily serves licensed real estate professionals, brokerages, builders, property managers, and other industry partners. We generally do not provide services directly to homeowners who are listing their property “For Sale By Owner” (FSBO).

We may, at our sole discretion, agree to provide services in connection with an FSBO property under limited circumstances, including but not limited to:

• The homeowner is a licensed real estate agent or broker;

• A licensed real estate agent is professionally involved in the transaction or stands to benefit from the sale of the property (for example, an agent representing the buyer of the homeowner’s next property);

• The homeowner has an existing or pending listing agreement, referral arrangement, or other professional relationship with a licensed real estate agent or brokerage; or

• Another business justification approved by One27 Media management.

All FSBO-related work must be requested and approved through a One27 Media team member prior to booking. Bookings placed by FSBO homeowners without prior approval may be canceled at our discretion, and any deposit refunded. One27 Media reserves the right to decline any FSBO request without explanation.

FSBO-Specific Service Conditions. When One27 Media approves an FSBO project under one of the exceptions above, the following conditions apply in addition to the standard Terms set forth in this document:

• One free revision round. FSBO orders include one (1) round of minor revisions at no additional charge, rather than the two (2) rounds offered to professional clients. Additional rounds are subject to the standard $25 per round fee per Section 7.

• Consolidated written feedback. All revision requests must be submitted in writing in a single submission. One27 Media will not accept piecemeal revisions delivered across multiple messages, calls, or emails. Revisions submitted in multiple installments may, at our discretion, be treated as additional revision rounds and billed accordingly.

• Creative direction. One27 Media is a team of trained, professional real estate media specialists. Our photographers and editors select angles, composition, lighting, and post-processing styles based on years of experience capturing properties that sell. While we welcome reasonable, specific written feedback during the revision round, FSBO clients acknowledge that One27 Media retains final creative discretion over the Work. We reserve the right to decline revision requests that conflict with our professional standards, real estate marketing best practices, or MLS presentation norms.

• Return visit fee. Any request for One27 Media to return to the property after the original appointment to capture additional photos, angles, or content — for any reason, including but not limited to overlooked rooms, newly staged areas, or seller preference — will be subject to a return visit fee of a minimum of $275. The exact fee may be higher depending on the scope of the return shoot, travel distance, and additional editing required.

• Final delivery is final. After the one (1) included revision round, the Work is considered final. Subsequent change requests will be quoted as new orders or additional revisions at our discretion.

3. Property Readiness

• The Client is expected to have the property “camera ready” prior to the beginning of the arrival window. This includes all cleaning and furniture staging.

• We ask that you have your clients review our Getting Ready checklist.

• If the One27 Media photographer arrives at the appointment and the home is not ready, the property will be shot “As Is.”

• We value your feedback and input for choosing the best angles to capture the property. If you would like to give input, please meet the team member at the beginning of the appointment or add notes in the “comments” section of the order.

• Absent your input, the One27 Media team member will use his/her best judgment and experience to decide which angles will best highlight the property.

4. Property Access and Preparation

• Client must confirm lockbox codes, key access, or other entry arrangements no later than 24 hours before the scheduled appointment.

• All pets must be secured (crated, boarded, or removed from the premises) prior to the appointment. Loose pets may result in the appointment being rescheduled or shot “As Is” at One27 Media’s discretion.

• All occupants must be cleared from areas being photographed or filmed.

• Client must disclose any known hazards, structural issues, or safety concerns prior to the appointment.

• If our team is unable to access the property at the scheduled time due to lack of access, unsecured pets, or undisclosed hazards, the appointment may be rescheduled and the reshoot fee in Section 6 may apply.

5. Order Details and Accuracy

• The Client is expected to have accurately entered or communicated all pertinent information at the time the order is placed.

• One27 Media reserves the right to update incorrect information and adjust the pricing of the order to accurately reflect the scope of work (for example, if the Client enters that the property is 1,500 square feet but it is actually 2,600 square feet).

• Our residential pricing reflects the cost for a single dwelling in a residential household. For commercial or multi-unit properties, please see our commercial or rental order pages.

6. Reschedule, Cancellation, and Reshoot Policy

• Confirmed appointments canceled or rescheduled within 24 hours before the appointment start time are subject to a $50 cancellation fee at One27 Media’s discretion.

• Appointments that cannot be completed due to weather or other conditions preventing our team from safely performing services (e.g., drone flights in rain or high winds, heavy rain preventing exterior capture) will be rescheduled without penalty, and the $50 cancellation fee will be waived.

• If a reshoot is required due to Client error — including but not limited to the property not being ready, lack of access (locked out, lockbox code not provided), unsecured pets, incorrect address, or undisclosed property conditions — the Client will be charged a $250 reshoot fee.

• One27 Media team members reserve the right to decline to shoot or leave a property if conditions are deemed unsafe (including but not limited to aggressive pets, biohazards, unsafe structures, hoarding conditions, or other hazardous conditions). In such cases, the $50 cancellation fee will apply and the Client may be subject to the reshoot fee if the conditions were known and undisclosed.

7. Revisions

• Each order includes up to two (2) rounds of minor revisions at no additional charge.

• Additional revision rounds beyond the initial two are subject to a $25 fee per round at One27 Media’s discretion.

• Revisions are limited to reasonable adjustments to delivered media. Requests that require reshooting the property are considered reshoots, not revisions, and will be quoted separately.

• Revision requests must be submitted within 7 days of delivery. After 7 days, the order is considered final and accepted.

• Video song choices and creative direction. For all video products (Cinematic, Vertical, Quick Tour, and other video edits), any song choices, music recommendations, branding requests, or other specific creative direction for the video edit must be communicated to One27 Media on or before the day of the shoot. Requests received after the shoot day will not be incorporated into the initial edit. Song changes, music swaps, or other creative direction submitted after the original delivery are considered a re-edit and are subject to a minimum $50 re-edit fee, in addition to any applicable revision round fees per this section.

8. Payment Terms

• You will be invoiced after all media has been delivered. Payment is due upon receipt of the invoice.

• After 15 days of non-payment, a late fee of $25 per month will be assessed.

• If there is a balance on your account that is over 45 days outstanding, One27 Media will freeze all assets and pause the ordering process until the balance has been paid.

• After 90 days of non-payment, the account will be sent to collections.

9. Service Area Coverage

One27 Media services Flagler, Volusia, and St. Johns counties. Appointments outside of this service area are subject to a $50 travel fee. Additional travel time, mileage, or overnight charges may apply for appointments significantly outside our service area.

10. Drone and Aerial Services

• All drone flights are conducted in compliance with FAA Part 107 regulations and all applicable federal, state, and local laws.

• Drone flights are subject to airspace restrictions, weather conditions, and LAANC airspace authorization where required. If One27 Media is unable to legally or safely operate the drone, the flight will be rescheduled when possible; however, no refund or credit will be issued for the drone portion of the package if the restriction is outside of our control.

• The Client is responsible for disclosing in advance any HOA rules, neighbor restrictions, noise ordinances, or other local restrictions that may affect drone operations at the property.

• One27 Media assumes no liability for complaints, disputes, or damages resulting from drone operations conducted in good faith compliance with FAA regulations.

11. Hosting

One27 Media will guarantee media hosting for one (1) year from the appointment date. Once the hosting time expires, the Client is responsible for permanent media storage. One27 Media is not responsible for retrieval of media after the hosting period ends.

12. Delivery Times

Next Business Day Following Appointment (before 5:00 p.m.):

• HDR Photography

• Aerial/Drone Packages

• Floor Plans

• Virtual Twilights

• Virtual Staging

• Twilight Photo Edits

Up to 3 Business Days Following Appointment (before 5:00 p.m.):

• Video Edits (Cinematic, Vertical, and Quick Tour)

• Zillow 3D Tour

13. Virtual Staging and Virtual Twilight Disclosure

• The Client agrees to clearly and conspicuously label any virtually staged or virtually enhanced twilight images as such in all marketing materials, MLS listings, and public-facing uses, in accordance with applicable MLS rules and real estate disclosure laws.

• The Client assumes full responsibility and liability for any claims, complaints, disputes, or damages arising from the Client’s failure to properly disclose virtually staged or virtually enhanced media. The Client agrees to indemnify and hold harmless One27 Media from any such claims.

14. Rights and Usage

14.1 Grant of Rights

You hereby grant to One27 Media, and its affiliates, contractors, commercial partners, licensees, successors, and assigns a non-exclusive, perpetual, fully transferable, sublicensable worldwide right and license to create, reproduce, display, transmit, and distribute the Work through any and all media now known or hereinafter developed. The “Work” is defined as photo(s), video(s), and/or 3D content, floor plans, graphics, audio, animation, constituent files, and other visual content of the property produced under these Terms including any derivative works created therefrom. Any and all rights not expressly granted here are reserved to One27 Media, including copyright and ownership rights in the Work. One27 Media reserves the right to use the Work for the company’s portfolio, samples, self-promotions, entry in contests or exhibitions, editorial use, or for display within or on the outside of One27 Media premises. One27 Media further reserves the right to assign, transfer, license, distribute, or syndicate the Work and any and all rights in the Work to its commercial partners. Except as explicitly set forth in Section 14.2 herein, you have no ownership rights in the Work and no right to sell or license the Work to any third party or copy, modify, reproduce, or create derivatives of the Work without the prior written consent of One27 Media.

14.2 Real Estate Listing Usage Rights

In exchange for the Grant of Rights set forth herein, One27 Media grants to you the right to use the images created from the Work and provided to you by One27 Media for purposes of marketing and promoting the Property, promoting your real estate business and/or the listing(s), your brokerage(s), and/or your business(es) (“Your License”). Your License is non-exclusive, non-transferable, covers all territories and media, and is for an unlimited time on websites owned by you. You may authorize third-party websites such as, but not limited to, Multiple Listing Service (MLS) or real estate listing portal websites to display said content solely for the purpose of advertising the subject listing, for as long as said listing is actively listed for sale by that listing agent. Your authorization to third-party websites will automatically expire once said listing is no longer available for sale or any relevant listing agreement between the Property owner and the listing agent has ended, whichever comes first.

14.3 Listing Transfers

In the event that a property listing changes agents or brokerages:

• The original ordering agent’s license to use the Work expires automatically when that agent’s listing agreement ends.

• The Work may not be transferred to, shared with, or used by any subsequent listing agent without obtaining a license directly from One27 Media.

• Subsequent listing agents may purchase a license transfer from One27 Media for a fee to continue using the existing media, subject to our then-current license transfer rates and availability.

• Use of the Work by any unlicensed party constitutes copyright infringement and may result in legal action.

14.4 Short Term/Long Term Rental Usage Rights

All photos and videos provided by One27 Media for short-term or long-term rental listings are licensed with a multi-use, non-transferable license specifically for marketing the property across platforms such as Airbnb, VRBO, Booking.com, and similar rental sites. This license also includes the right to use the media on:

• Social media platforms (e.g., Instagram, Facebook, TikTok, YouTube)

• The property owner’s personal or business website

• Digital ads promoting the rental property

Please note:

• The media is licensed, not sold. One27 Media retains full copyright ownership of all content.

• The license is granted to the property owner or authorized agent and may not be transferred, sold, or reused for other properties.

• Usage is limited to marketing the licensed property as a rental. Use for resale, third-party promotion, or other commercial purposes requires separate written permission or licensing.

• Media must not be altered in a misleading way (e.g., using filters or edits that misrepresent the property).

By using our services, you agree to these Terms and acknowledge One27 Media’s ongoing copyright ownership of all delivered content.

15. Releases, Licenses, and Authorizations

By contracting with One27 Media to produce the Work, you warrant and represent that you are authorized to enter into this Agreement with regard to the Property and you certify that you have obtained all appropriate and necessary releases, permissions, waivers, licenses, and/or authorizations (“Clearances”) for the Grant of Rights and Usage Rights set forth in these Terms and Conditions, including but not limited to Clearances from the owner of the Property and any other owners of intellectual property rights contained in, on, or around the Property and captured as part of the Work, including the underlying architectural work. You further warrant and represent that the Property owner and any occupants of the Property have waived any expectation of privacy rights in relation to the images captured and distributed in accordance with the grant of rights hereunder. You agree to indemnify and hold harmless One27 Media against any and all claims, costs, and expenses, including attorney’s fees, due to uses of the Work for which you did not obtain the appropriate Clearance, including uses that exceeded the Clearances actually obtained by you.

16. Model Release

The Client warrants that all persons appearing in the Work — including but not limited to agents, property owners, occupants, guests, models, or other individuals — have provided their informed consent to being photographed and/or filmed, and have consented to the use of their likeness in accordance with the rights granted under these Terms. The Client is solely responsible for obtaining all necessary model releases and will indemnify and hold harmless One27 Media from any claims arising from the use of any person’s likeness in the Work.

17. Confidentiality

One27 Media and its team members will treat all non-public property details, security/alarm codes, access information, occupant information, and other sensitive information disclosed in the course of performing services as confidential. One27 Media will not disclose such information to third parties except as necessary to perform the contracted services, as required by law, or with the Client’s consent.

18. Force Majeure

One27 Media shall not be liable for any delay in performance, failure to perform, or inability to deliver services due to circumstances beyond our reasonable control, including but not limited to: weather conditions, illness of personnel, equipment failure, power outages, internet or software outages, natural disasters, fires, floods, hurricanes, pandemics, government restrictions or orders, acts of terrorism, or other acts of God. In the event of such circumstances, One27 Media will make reasonable efforts to reschedule affected appointments without penalty to either party.

19. Limitation of Liability

To the maximum extent permitted by law, One27 Media’s total liability to the Client for any claim arising out of or relating to these Terms or the services provided — whether in contract, tort, or otherwise — shall not exceed the total amount paid by the Client to One27 Media for the specific order giving rise to the claim. One27 Media shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to lost profits, lost commissions, lost business opportunities, or loss of goodwill. The foregoing limitations do not apply in cases of gross negligence or willful misconduct by One27 Media. Nothing in this section limits the Client’s other rights or remedies under applicable law to the extent such limitation is prohibited.

20. Indemnification and Hold Harmless

In addition to the terms and conditions contained in Section 15, you shall also indemnify and hold One27 Media LLC, its officers, members, employees, contractors, licensees, sublicensees, agents, successors, and assigns harmless from and against any and all liability, claims, injuries, damages, loss, and expense (including court costs and reasonable attorney’s fees) resulting from the performance of this Agreement, or any distribution or use of the Work created hereunder resulting from your breach of any warranties, representations, or certifications hereunder, or resulting from your negligent or intentional acts or omissions and/or those of your officers, agents, independent contractors, employees, family members, invitees, licensors, the Property owner, and/or guests.

21. Governing Law, Venue, and Dispute Resolution

• These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles.

• Any dispute arising out of or relating to these Terms or the services provided shall be resolved exclusively in the state or federal courts located in Flagler County, Florida, and the parties consent to the personal jurisdiction of such courts.

• Before initiating any litigation, the parties agree to attempt to resolve the dispute through good-faith mediation with a neutral mediator mutually agreed upon by both parties. The cost of mediation shall be shared equally between the parties.

• In any action or proceeding to enforce these Terms, the prevailing party shall be entitled to recover its reasonable attorney’s fees and costs from the non-prevailing party.

22. General Provisions

• Entire Agreement: These Terms, together with any signed agreements or order forms, constitute the entire agreement between the parties and supersede all prior or contemporaneous agreements, proposals, or communications, whether oral or written.

• Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

• No Waiver: The failure of One27 Media to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.

• Assignment: The Client may not assign or transfer these Terms or any rights hereunder without the prior written consent of One27 Media. One27 Media may assign these Terms at its discretion.

• Notices: All formal notices under these Terms shall be sent to One27 Media at hello@one27mediallc.com.

• Headings: Section headings are for convenience only and do not affect the interpretation of these Terms.
